This monograph draws in particular on the solutions of continental legal systems, but also includes an analysis of the Anglo-Saxon tradition, for comparative purposes. The author is a Senior Counsel of the Hungarian Supreme Court (Curia), and is also an Associate Professor and formerly a practising lawyer. For this reason, the emphasis in this work is not only on the theoretical but also on the practical aspects, with particular reference to Hungarian judicial practice.
